    Introduction: Why This Topic Matters

    Most students in India grow up believing that schools have unlimited power over them.
    Punishments, humiliation, suspensions, and strict rules are often accepted as “normal discipline”.

    But the truth is very different.

    👉 Students do not lose their legal rights inside school premises.
    In fact, Indian law strongly protects children from abuse, harassment, and illegal punishment.

    This article explains every important right of students in school, in detail, with legal backing.


    Who Is Considered a “Student” Under Law?

    Under Indian law, a student is:

    • A child under 18 years of age
    • A citizen of India
    • A rights-holder, not a subject

    Students are protected by:

    • The Constitution of India
    • Right to Education Act, 2009
    • Juvenile Justice Act, 2015
    • POCSO Act, 2012
    • Board guidelines (CBSE, ICSE, State Boards)

    Schools are bound by law.


    Section 1: Right to Life, Dignity & Respect (Article 21)

    Legal Basis

    Article 21 of the Constitution of India guarantees:

    “Right to life with dignity.”

    This right applies inside school classrooms as well.

    What This Means in School

    Schools and teachers:

    • Must treat students with respect
    • Cannot insult, threaten, or humiliate
    • Cannot destroy a child’s self-esteem

    Illegal Practices (Still Common)

    ❌ Making students stand on benches
    ❌ Holding ears as punishment

    Mental harassment is as serious as physical abuse.
