    Educators, legal scholars, and civil services mentors increasingly highlight this topic to explain how Indian law treats consent within marriage and why this issue remains controversial even today.

    This article explains what marital rape is, what Indian law currently says, why the debate exists, and what reforms are being discussed, in clear and simple terms.


    What Is Marital Rape?

    Marital rape refers to non-consensual sexual intercourse by one spouse with the other spouse.

    The key concept here is consent.

    • Consent means free, voluntary, and informed agreement
    • Silence, fear, pressure, or marriage itself does not amount to consent
    • If consent is absent, sexual intercourse becomes a violation of bodily autonomy

    The debate arises because marriage has historically been treated differently under criminal law.

    Under Indian criminal law, forced sexual intercourse by a husband with his adult wife is generally not treated as rape, provided:

    • The wife is above the legally prescribed age
    • The spouses are not living separately under judicial separation

    This exception has existed in law for decades and is rooted in old legal assumptions about marriage.

    However, if spouses are legally separated, forced sexual intercourse may attract criminal liability under existing provisions.

    The marital rape exception developed from outdated ideas such as:

    • Marriage implies permanent consent
